1. Purpose
This policy outlines how NZ Tutoring will handle Personal Information collected, held, used, disclosed and disposed of during the course of conducting a tutoring business, providing the requirements of the Privacy Act 2020 is not contravened.
2. Personal Information
Personal Information is defined as information or opinions about any student, staff member, volunteer or contractor, recorded in a material form or not.
3. Personal Information Collected
The types of Personal Information possibly collected, held, used and disclosed by NZ Tutoring on individuals and organisations will depend upon the nature of the relationship with them. Personal Information collected on individuals and organisations may include (but is not limited to) the following:

contact details including telephone numbers (landline and/or mobile)

year level

identification information such as driving licence details (incl driving licence number), teacher accreditation number, working rights verification documents.

information from or in connection with any job vacancy NZ Tutoring may have and which is applied for by any individual

professional training, accreditations or qualifications

police check

geographical location (postcode, time zone)

IRD number, GST number, and New Zealand Business Number (NZBN), as applicable

photographs, video interviews, call recordings, lesson recordings and/or images and video footage.

family relationship.
NZ Tutoring collects and records Personal Information about individuals and organisations such as:

our students, potential students and their parents or guardians
-
our tutors
-
our investors and shareholders
-
our suppliers and potential suppliers and their representatives, directors, partners, proprietors and shareholders

contractors and subcontractors and potential contractors and subcontractors and their representatives in relation to providing goods and services to us
-
our employees past and present, including applicants, and
-
any other person who comes into contact with NZ Tutoring.
4. Collection of Personal Information
NZ Tutoring collects Personal Information to conduct business functions, to provide, market and sell products and services and for the specified purposes set out in paragraph 5. In some circumstances the collection of Personal Information may be required by law.
5. Use of Personal Information
NZ Tutoring uses Personal Information of individuals and organisations collected for our business functions and activities, in order to operate our business efficiently, and to market our products and services for the benefit of our customers.
NZ Tutoring reserves the right at all times to monitor, review, retain, and/or disclose any information as necessary to satisfy any applicable law. NZ Tutoring is not obliged to monitor the use of any Website operated by NZ Tutoring or to retain the content of any user session.
Individuals and organisations consent to NZ Tutoring using Personal Information in the above ways and as set out in Section 6 of the Policy.
NZ Tutoring may otherwise collect, use or disclose Personal Information of individuals and organisations where the collection, use or disclosure is:

in accordance with this Privacy Policy or any agreement entered into with NZ Tutoring, or,

as required or authorised by law, including without limitation the Information Privacy Principles under the Privacy Act 2020.
6. Disclosure of Personal Information
NZ Tutoring may disclose, or provide access to Personal Information of individuals and organisations to third parties in connection with the purposes described in paragraph 5. Depending on the circumstances and the nature of individuals and organisations engagement with NZ Tutoring, we may disclose Personal Information to our related entities, to third parties that provide products and services to NZ Tutoring or through NZ Tutoring, or to other third parties (such as referee(s) in connection with job applications).
NZ Tutoring may also disclose Personal Information of individuals or organisations to:

any of NZ Tutoring’s tutors, internal divisions, business units or departments,

parent or guardians if individuals are younger than 15 years old,

nominated representatives of individuals or organisations,

other organisations or individuals who assist NZ Tutoring in providing products and services,

professional service providers and advisors who perform functions on NZ Tutoring’s behalf, such as lawyers,

medical providers including medical and rehabilitation practitioners for assessing insurance claims,

representatives, agents or contractors who are appointed by NZ Tutoring in the ordinary operation of our business to assist us in providing goods or services or administering our business (such as for data storage or processing, printing, mailing, marketing, planning and product or service development),

debt collecting agencies,

banks, lenders, valuers, insurers, brokers, auditors, business consultants and IT service providers, and
-
Government, regulatory authorities and other organisations as required or authorised by law.
NZ Tutoring may also disclose Personal Information of individuals and organisations to our Website host or software application providers in certain limited circumstances, for example when our Website experiences a technical problem or to ensure that it operates in an effective and secure manner.
NZ Tutoring may buy, merge or partner with other companies or organisations, and in so doing, acquire customer Personal Information. In such transactions, Personal Information may be among the transferred assets. Similarly, in the event that a portion or substantially all of NZ Tutoring’s business or assets are sold or transferred to a third party, NZ Tutoring may also disclose certain information including Personal Information of individuals and organisations to a purchaser or potential purchaser in connection with the sale or potential sale of NZ Tutoring, our business or any of our assets, including in insolvency.

7. Other uses and disclosures
NZ Tutoring may collect, use and disclose Personal Information of individuals and organisations for other purposes not listed in this Privacy Policy. If NZ Tutoring does so, we will make it known to individuals and organisations at the time Personal Information is collected and used.

8. Storage and security of Personal Information
NZ Tutoring aims to keep Personal Information of individuals and organisations secure. Any Personal Information that is collected via NZ Tutoring’s Website or which is held on NZ Tutoring’s computer systems is protected by safeguards including physical, technical (firewalls, SSL encryption etc) and procedural methods.
If Personal information of individuals and organisations is longer required or NZ Tutoring may de-identify it or remove it from our systems and destroy all record of it.

9. Updating Personal Information
Individuals and organisations are generally entitled to access Personal Information relating to them, held by NZ Tutoring. Depending on the nature of the request, NZ Tutoring may charge for providing access to this information, however such charge will be reasonable in the circumstances.
Individuals and organisations are advised that there may be legal or administrative reasons to deny access to Personal Information. If access to Personal Information is denied, NZ Tutoring will provide reasons for the refusal where required by law to do so.
Requests for access to Personal Information can be made by contacting NZ Tutoring in any of the ways specified in Section 11.
NZ Tutoring takes all reasonable steps, including periodically asking individuals and organisations to ensure that any Personal Information collected and used is accurate, complete and up-to-date.
10. Complaints
Individuals and organisations who feel NZ Tutoring has not respected their privacy or that NZ Tutoring has been inconsistent with this Privacy Policy, are asked to contact NZ Tutoring in any of the ways specified in Section 11 as soon as possible.
Queries and privacy complaints will be investigated within a reasonable period of time depending on the complexity of the complaint and the complainant will be notified of the outcome of the investigation.

12. Updates to this Privacy Policy
NZ Tutoring may, from time to time, review and update this Privacy Policy, including taking into account new laws, regulations, practices and technology. All Personal Information held by NZ Tutoring will be governed by our most recent Privacy Policy.
